In the case involving Wout van Aert and Nick Nuyens with his Sniper Cycling, the Belgian Supreme Court yesterday confirmed the 2021 labor court ruling, establishing that the Flemish rider must pay Nuyens a compensation of 662,000 euros. The amount set by the Supreme Court has already been paid by Van Aert, and Nuyens will not receive the 1.1 million euros he had requested.
The war, however, does not seem to be over, and Nuyens is now reportedly intending to file a new lawsuit, this time against Visma-Lease a Bike. We are facing one of the longest legal battles in the world of cycling: the events date back to the autumn of 2018, when Van Aert terminated his contract with Sniper Cycling, Nick Nuyens' holding company, to go and race with Jumbo-Visma. At the time, Van Aert decided to use as an urgent motivation the impossibility of continuing his life normally within the team, highlighting the incompatibility between the parties.
Nuyens was obviously not in favor of giving up a champion like the Belgian and from the beginning maintained that Van Aert had illegitimately violated his contract and therefore demanded damages worth 1.1 million euros. In 2021, the labor court fully sided with Nuyens, imposing on Van Aert to pay a severance indemnity of 662,041.31 euros.
A considerable sum that Van Aert paid immediately. Subsequently, both parties appealed to the Supreme Court: Nuyens believed the severance indemnity was too low, while Van Aert no longer wanted to pay any more money. The Supreme Court issued its verdict yesterday, but this does not mean that the conflict between Van Aert and Nuyens is over, and the case could be passed to the UCI.
Since 2018, the International Cycling Union has always adopted a wait-and-see attitude, however emphasizing that if Van Aert had unjustly violated his contract, the UCI would have maintained the right to take disciplinary measures against all parties involved.
Therefore, if the UCI were to decide to intervene, even under Nuyens' push, Van Aert and his Visma-Lease a Bike could incur new sanctions. In the worst-case scenario, the Flemish rider could be suspended from activity for a short period, although this seems quite unlikely, while the position of Visma-Lease a Bike could be quite different, as they might receive a financial sanction. Nuyens will probably insist that the UCI strictly apply the regulations: according to Rudi Desmet, Nuyens and Sniper's lawyer, there are grounds for a new proceeding, as it is clear that Wout van Aert violated his contract with a false argument.
Nuyens now hopes for substantial compensation from Visma-Lease a Bike through the UCI: the Dutch team could be forced to pay an amount equal to the severance, namely 662,000 euros.
