The Lazio TAR does not halt, for now, the commissioning of the Professional Cycling League. With an order filed after the hearing on October 7, the First Section rejected the suspension request filed by Marco Toni, who sought to block the acts by which the Italian Cycling Federation had entrusted the management of the entity to Mauro Capone.
The target of the appeal were the resolution of the Federal Council of July 20, which ordered the commissioning, and the urgent resolution of the federal president of August 6, ratified on August 18, which transferred to the commissioner the powers to manage professional activities. Also contested was the administrative and accounting verification report of July 15, from which the matter originated, with a request for damages compensation.
The point that weighed heavily, however, was procedural in nature: the judges harbor serious doubts about the admissibility of the appeal, because Toni did not first challenge the resolution before the sports justice bodies. Hence the rejection of the precautionary measure. The matter, however, is deemed complex, also in light of the judgment of the Court of Justice of the European Union of July 16, 2026 cited by the appellant, and requires further examination: the discussion is scheduled for the public hearing on February 24, 2027. The League will remain under the commissioner's control.
